PRIVACY AND SECURITY POLICY

The website urbanarmourgear.com (the “Site”) is owned and operated by Urban Armor Gear, LLC (“UAG,” “we,” “us,” “our”).  Our Privacy Policy (the “Policy”) was developed to help you understand the type of information we collect on our Site and how this information is used.  This Policy should be read in conjunction with our website Terms of Use, into which this Policy is incorporated by reference.  This policy applies to information we collect:

  • on this Site;
  • in email, text, and other electronic messages between you and this Site; and
  • when you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy. 

The Policy does not apply to information collected by us offline or through any other means, including on any other website operated by UAG or any third party (including our affiliates and subsidiaries).

Please read this Policy carefully to understand our practices regarding your information and how we will treat it. If you do not agree with our Policy and practices, then your choice is not to use our Site. By accessing or using this Site, you agree to this Policy. This Policy may change from time to time. Your continued use of this Site after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

What We Collect and How We Collect It. To ensure that we provide you with the best possible experience, we will store, use, and share information about you in accordance with this Policy.

Information You Provide to Us. We collect several types of information from and about users of our Site, including Personal Information.  Personal Information is any information that can be used to individually identify you from a larger group, such as data including, but not limited to, your:

  • Name
  • telephone number
  • email address
  • billing address
  • credit card or PayPal account information
  • transaction data
  • marketing and communications data
  • IP address/domain name
  • Personal Information you may have volunteered

You may provide us Personal Information when you:

  • purchase a product
  • register with the Site
  • sign up for our emails

You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Site, or transmitted to other users of the Site or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. We cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

By using this site, you consent to the collection and use of this information by UAG. 

Automatic Data Collection TechnologiesOur Site uses cookies and similar data collection technologies to provide you with an enhanced shopping experience while visiting our Site.  As you navigate through and interact with our Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including details of your visits to our Site and information about your computer and internet connection, including your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). We may also employ third-party services that keep track of your browsing activities when you are served content.  We have also provided more information about opting out of some functions below called “Your Choices About Disclosure.”

We use the following data collection and storage methods:

  • Cookies: A “cookie” is a small data file transmitted from a website to your computer’s hard drive.  Cookies are usually defined in one of two ways, and we may use both:  (1) session cookies, which do not stay on your computer after you close your browser, and (2) persistent cookies, which remain on your computer until you delete them or they expire. . Our Site uses cookies to track your visits through Google Analytics, Google Adwords, and Google Analytics Remarketing in conjunction with DoubleClick as described in the following paragraphs.  You can change your browser settings to refuse cookies or alert you when a cookie is being sent at any time. We do not use cookies to identify you personally.
  • Cookies/Google Analytics:The Site sends aggregated, non-Personal Information to Google Analytics for the purpose of providing us with the ability to conduct technical and statistical analysis on the Site’s performance. This cookie allows us to see information on user Site activities including, but not limited to page views, source and time spent on Site. The information is depersonalized and is displayed as numbers, meaning it cannot be tracked by to individuals. This will help protect your privacy. Using Google Analytics, we can see what content is popular on the Site and strive to give you more of the things you enjoy reading and watching.
  • Google AdWords: Using Google AdWords,we are able to see which pages helped lead to contact form submissions, software downloads, and purchases. This allows us to make better use of our paid search budget.
  • Remarketing with Google Adwords: We use Remarketing with Google Adwords to advertise online. Third-party vendors, including Google, show our ads on sites across the internet. NWPS and third-party vendors, including Google, use first-party cookies (such as the Google Analytics & Adwords cookie) and third-party cookies (such as the DoubleClick, Criteo, Klaviyo, & Facebook cookie) together to inform, optimize, and serve ads based on someone’s past visits to our Site.

  • Email Messages to Our Email Accounts: email addresses sent to our email accounts by non-customers are not added/sold/transferred to any mailing list. At our discretion, we may retain a copy of the received message and our outgoing email message for future reference.
  • Web Beacons: A Web Beacon is an electronic image.  Web Beacons can track certain things from your computer and can report activity back to a web server allowing us to understand some of your behavior.  If you choose to receive emails from us, we may use Web Beacons to track your reaction to our emails.  We may also use them to track if you click on the links and at what time and date you do so.  Some of our third-party marketing partners may use Web Beacons to track your interaction with online advertising banners on our Site.  This information is only collected in aggregate form and will not be linked to your Personal Information.  Please note that any image file on a webpage can act as a Web Beacon.
  • Embedded Web Links: Links provided in our emails and, in some cases, on third-party websites may include tracking technology embedded in the link.  The tracking is accomplished through a redirection system.  The redirection system allows us to understand how the link is being used by email recipients.  Some of these links will enable us to identify that you have personally clicked on the link and this may be attached to the Personal Information that we hold about you.  This data is used to improve our service to you and to help us understand the performance of our marketing campaigns.
  • Third-party Websites and Services. We work with a number of service providers of marketing communications technology.  These service providers may use various data collection methods to improve the performance of the marketing campaigns we are contracting them to provide.  The information collected can be gathered on our Site and also on the websites where our marketing communications are appearing.  For example, we may collect data where our banner advertisements are displayed on third-party websites.

Do Not Track Disclosure.  Other than as disclosed in this Policy, the Site does not track users over time and across third-party websites to provide targeted advertising.  Therefore, the Site does not operate any differently when it receives Do Not Track (“DNT”) signals from your internet web browser.

Your Choices About Disclosure.  We have created mechanisms to provide you with the following control over some of your information:

In addition, we want to provide you with relevant information that you have requested. If we provide subscription-based services, such as email newsletters, we will allow you to make choices about what information you provide at the point of information collection or at any time after you have received a communication from us while you are subscribed.  Any transactional or service-oriented messages are usually excluded from such preferences, as such messages are required to respond to your requests or to provide goods and services, and are not intended for the purposes of marketing.

We will not intentionally send you email newsletters and marketing emails unless you consent to receive such marketing information.  After you request to receive these emails, you may opt out of them at any time by selecting the “unsubscribe” link  at the bottom of each email.  Please note that by opting out or unsubscribing you may affect other services you have requested we provide to you, in which email communication is a requirement of the service provided.

Any such communications you receive from us will be administered in accordance with your preferences and this Policy.

Accuracy and Access to Your Personal Information.  We strive to maintain and process your information accurately.  We have processes in place to maintain all of our information in accordance with relevant data governance frameworks and legal requirements.  We employ technologies designed to help us maintain information accuracy on input and processing.

Where we can provide you access to your Personal Information in our possession, we will always ask you for a username and password to help protect your privacy and security.  We recommend that you keep your password safe, that you change it periodically, and that you do not disclose it to any other person or allow any other person to use it.

To view and change the Personal Information that you have provided to us, you can log in to your account and follow the instructions on that webpage, or contact us directly for assistance.

How We Use Your Information. We use information that we collect about you or that you provide to us, including any Personal Information:

  • To present our Site and its contents to you.
  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our Site or any products or services we offer or provide through it.
  • To allow you to participate in interactive features on our Site.
  • To advertise our products and offerings to you.
  • In any other way, we may describe when you provide the information.

Disclosure of Information. We may disclose aggregated, non-identifying information about our users without restriction, subject to this Policy.  We may disclose Personal Information that we collect or you provide in the following circumstances:

  • To contractors, service providers, and other third parties we use to support our business and marketing operations;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of UAG's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by UAG about our Site users is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our terms of use and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of UAG, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We do not sell any of our customer’s information to anyone. There are circumstances where UAG may decide to buy, sell, or reorganize its business in selected countries.  Under these circumstances, it may be necessary to share or receive Personal Information with prospective or actual partners or affiliates.  In such circumstances, UAG will ensure that your information is used in accordance with this Policy.

Changes to this Policy.  We update this Site periodically. Therefore, our policies may change accordingly depending on the nature of these changes. It is our policy to post any changes we make to our Policy on this page, and we notify you about material changes through a notice on the Site home page. The date the Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for visiting our Site and this Policy to check for any changes.

Children Under Age 13.  Our Site is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Site. We do not knowingly request or collect personally identifiable information from anyone under the age of 13.  If you are under 13, do not use or provide any information on this Site or on or through any of its features, register on the Site, make any purchases through the Site, use any of the interactive or public comment features of this Site or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. Third-party Websites.  This Policy does not apply to websites or other domains that are maintained or operated by third parties or our affiliates.  This Site may link to third-party websites and services, but these links are not endorsements of these sites, and this Policy does not extend to them.  Because this Policy is not enforced on these third-party websites, we encourage you to read any posted privacy policy of the third-party website before using the service or site and providing any information.

Your California Privacy Rights.  California Civil Code Section § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Data Security.  We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. Our site is hosted on secure servers and all transactions are carried out through a secure shopping cart that is PCI-DSS compliant.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Site like message boards. The information you share in public areas may be viewed by any user of the Site. Moreover, at no time should you use email to transmit your financial information to us as email is not a secure channel.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Site. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

Disclosure in the United States.  You acknowledge that UAG is based in and operates its business in the United States.  The information that you provide to UAG or its affiliates is being provided to a business in the United States and managed in the United States, even if you are not located in the United States.

For Website Visitors in the European Union (“EU”).  Under the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, or “GDPR”), individuals in the EU are afforded specific rights with respect to their Personal Information, or “personal data” as defined under the GDPR.  For the purposes of this Policy, UAG operates as a data controller.  Any personal data we collect from you is processed in the United States and under the terms of this Policy.

Any personal data we collect from you is processed in the legitimate interest of our business and providing our services to you as the lawful means of such processing.  You may always withdraw your consent to our use of your personal data as described below.  We will only retain your personal data for the time necessary to provide you the information and services to which you have consented, to comply with the law and in accordance with your rights below.

You can exercise any of the following rights by notifying us as described below:

  • Access. You may email us at support@urbanarmorgear.com to request a copy of the personal data our Site databases currently contain.
  • Correction or Rectification. You can correct what personal data our Site database currently contains by accessing your account directly, or by emailing us at support@urbanarmorgear.com to request that we correct or rectify any personal data that you have provided to us.  We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause information to be incorrect.  Where applicable, we will ensure such changes are shared with trusted third parties.
  • Restricted Processing. When applicable, you may restrict the processing of your personal data by submitting a request via email to support@urbanarmorgear.com. In your email, please explain how you wish us to restrict processing of your personal data.  When such restrictions are not possible, we will advise you accordingly.  You can then choose to exercise any other rights under this Policy, to include withdrawing your consent to the processing of your personal data. Where applicable, we will ensure such changes are shared with trusted third parties.
  • Object to Processing. When applicable, you have the right to object to the processing of your personal data by submitting a request via email to support@urbanarmorgear.com.  When such objections are not possible, we will advise you accordingly.  You can then choose to exercise any other rights under this Policy, to include withdrawing your consent to the processing of your personal data. Where applicable, we will ensure such changes are shared with trusted third parties.
  • Upon request and when possible, we can provide you with copies of your personal data.  You may submit a request via email to support@urbanarmorgear.com.  When such a request cannot be honored, we will advise you accordingly.  You can then choose to exercise any other rights under this Policy, to include withdrawing your consent.  Where applicable, we will ensure such changes are shared with any trusted third parties.
  • Withdraw Consent. At any time, you may withdraw your consent to our processing of your personal data through this Site by notifying us via email at support@urbanarmorgear.com.  Using the same email address associated with your Site account, simply type the words “WITHDRAW CONSENT” in the subject line of your email.  Upon receipt of such a withdrawal of consent, we will confirm receipt and proceed to stop processing your personal data.  Where applicable, we will ensure such changes are shared with trusted third parties.
  • Erasure. If you should wish to cease use of our Site and have your personal data deleted from our Site, then you may submit a request by emailing us at support@urbanarmorgear.com.  Upon receipt of such a request for erasure, we will confirm receipt and will confirm once your personal data has been deleted.  Where applicable, we will ensure such changes are shared with trusted third parties.

Submit Complaints or Questions.  If you wish to raise a complaint on how we have handled your personal data, you can contact us as described below.  If you reside in a European Union member state, you may also lodge a complaint with the supervisory authority in your country.
